General Terms and Conditions of the DFB-Stiftung Deutsches Fußballmuseum gGmbH (hereinafter referred to as “DFM”) for the sale of admission tickets (hereinafter referred to as ‘tickets’) for visits to the permanent exhibition, whether purchased online or at the box office, as well as for the sale of tickets for other DFM events and offerings, including special exhibitions, guided tours, cultural events, children’s birthday parties and school group programmes, accompanying materials, merchandise and catering products.

  • 1. Scope and field of application

    The following General Terms and Conditions (“Terms and Conditions”) and the DFM’s House Rules, which will be sent to you in the confirmation email following your online purchase and are available for inspection in the entrance area. By ordering, purchasing or using a ticket, the respective person placing the order, purchaser or ticket holder accepts these Terms and Conditions and the DFM’s house rules.

  • 2. Formation and content of contracts

    2.1. Permanent and special
    exhibitions The contracting party for the purchase of the tickets listed under point 1 is the DFB-Stiftung Deutsches Fußballmuseum gGmbH. Contractual relationships are established exclusively between the DFM and the lawful ticket holder.
    Purchases can be made either via the online shop at www.fussballmuseum.de or at the DFM box office. The purchaser must be of legal age. When purchasing via the online shop, depending on the customer’s preference, the tickets are sent free of charge as e-tickets (PDF files) by email or, for an additional charge, as original tickets by post. It is not possible to have tickets held at the German Football Museum.
    When ordering tickets for self-printing, the ordering process in the DFM’s online shop at www.fussballmuseum.de is completed by clicking the ‘Complete order’ button. The DFM will confirm receipt of the order immediately. The contract is concluded upon acceptance of the order by the DFM. Acceptance takes place via email by sending an order confirmation or by sending the e-tickets in PDF format to the email address provided by the customer.
    Subsequent additions to an existing booking are only possible by making a new, additional booking via the standard booking channels and subject to the ticket availability at that time.
    Orders for tickets and any additional bookable offers cannot be subsequently amended or cancelled (either partially or in full). The exercise of statutory rights of withdrawal, warranty and rescission remains unaffected.

    2.2. Children’s birthday parties at the DFM
    The range of services and prices for children’s birthday parties can be found on the website www.fussballmuseum.de. The contracting party is the DFB-Stiftung Deutsches Fußballmuseum gGmbH. The following applies to orders and dispatch:
    a) The customer may select from the available offers and book the service subject to availability.
    b) The prices applicable at the time of booking, which include the applicable value-added tax, shall be decisive.
    c) The contract comes into effect upon successful completion of the booking. Verbal side agreements or subsequent amendments/additions are only binding if they have been confirmed in writing by the DFM.

    2.3. Special provisions for group bookings and bookings for children’s birthday parties
    If the number of visitors who actually attend is lower than the number booked, the DFM will not issue a refund. If the actual number or composition of visitors attending on the day differs from the booking, the DFM cannot guarantee that all attendees will receive the additional services mentioned in the sales information. Verbal side agreements or subsequent changes are only binding if they have been confirmed in writing by the DFM.

    2.4. Special provisions for booking catering services
    If the number of visitors who actually attend is lower than the number booked, the DFM shall not provide a refund.

  • 3. The complaint

    3.1. The customer/purchaser is obliged to check the confirmation email and/or the eTicket files, or the tickets handed over or sent, to ensure that the number, prices, date of visit and admission period or event date are correct. Any complaint must be made in writing by email or post to the contact address specified in clause 17 immediately (within three working days) of receipt of the tickets or documents, but before the date of the event. The postmark or the email transmission log shall be decisive for determining compliance with the complaint deadline. Once the complaint deadline has expired, there shall be no entitlement to a refund or to re-order the tickets.

    3.2. Sale of goods Unless otherwise agreed, the visitor shall be supplied with goods (guides for the museum rally, exhibition catalogue) in standard commercial quality and design, taking into account manufacturing tolerances for dimensions, weights and quality specifications, or handed over on site at the DFM.
    Should any goods purchased from the DFM exhibit obvious material or manufacturing defects, please report these to our staff immediately. However, failure to do so will not affect your statutory rights. The statutory warranty periods apply, and, at your discretion, you are entitled to the statutory rights to subsequent performance and rectification of defects.

  • 4. Payment terms/late payment

    Orders are, as a rule, only processed using the payment methods listed in the online shop. Should payment not be successfully completed for reasons attributable to the customer/purchaser – e.g. insufficient funds on the credit card or in the bank account, a chargeback or similar action taken by the customer/purchaser – DFM is entitled to cancel the order without replacement or to block the relevant tickets electronically. In justified cases, a debt collection agency will be commissioned to initiate debt recovery proceedings. We expressly reserve the right to claim further compensation (cancellation fees, chargeback fees, etc.).

  • 5. House Rules and Use of the DFM

    5.1. The purchase of a ticket to visit the DFM entitles the holder to make use of all services offered at the time of the visit, with the exception of those services for which an additional charge is required, as indicated in separate notices during the purchase process (e.g. guided tours, visits to special exhibitions).

    5.2. Visitors have no entitlement to expect that, at the time of their visit, all services which the DFM has indicated are available, in whatever form, will in fact be on offer. Reasons for this may include, for example, changes or technical updates in the exhibition areas. The DFM will indicate which services are unavailable at the entrance to the DFM and on its website as soon as it is established that a service will be unavailable for a longer period. Short-term unavailability of individual services will be indicated at the location where the service is provided. Individual availability depends on visitor demand and cannot therefore be guaranteed by the DFM.

    5.3. Visitors are obliged to comply with the rules of conduct, which are set out in the house rules displayed in the forecourt and at the entrance. In the event of non-compliance with the rules of conduct set out in the house rules, the DFM is entitled, in addition to claiming damages, to withdraw the relevant visitors’ right of access and to expel them from the DFM.

    5.4. All customers/purchasers who book tickets via the online advance booking service will receive a notice regarding the DFM’s house rules in their confirmation email. Furthermore, the house rules are displayed in the forecourt area and within the DFM building and are deemed to have been accepted by visitors. Failure to comply with the house rules may result in the loss of admission rights without compensation.   • 6. Ticket dispatch

    Depending on the purchaser’s preference and the ticket options available, tickets purchased in advance online will be sent free of charge by email as an e-ticket (PDF file) or, for an additional charge, by post. It is not possible to have tickets held at the DFM. The annual pass is sent exclusively by post.

    6.1. eTickets are sent in PDF format to the email address provided by the purchaser. In this case, no further admission ticket will be sent by post.

    6.2. The posting of tickets (and other items) is at the purchaser’s expense and risk. The risk of loss or damage to the tickets during dispatch is borne by the purchaser, unless there is gross negligence or wilful misconduct on the part of the DFM or persons commissioned by it. The DFM shall select the delivery company.

  • 7. Loss, cancellation and refunds of tickets

    7.1. Tickets cannot be exchanged under any circumstances; therefore, they cannot be returned.

    7.2. No replacement will be provided in the event of loss (lost, stolen or destroyed tickets). Damaged tickets may, in individual cases and subject to verification, be reprinted – i.e. reissued – only on a case-by-case basis, subject to proof of loss (e.g. by presenting the original tickets), and subject to a processing fee and, where applicable, a box-office surcharge. There is no legal entitlement to this procedure, and it is at the discretion of the DFM on a case-by-case basis.

    7.3. Special provision: closure of exhibition areas
    Should the DFM be closed in whole or in part due to a change in the programme on the date already booked by the visitor, the DFM reserves the right to offer visitors an alternative event or a refund.

    7.4. Rescheduling, curtailment or cancellation of an event
    Should an event at the DFM be rescheduled, the tickets shall remain valid in all cases. If the purchaser is unable to attend the rescheduled or repeated event, they shall be refunded the admission price upon return of the original tickets or upon simultaneous cancellation of the e-tickets. Service and postage charges shall not be refunded.

    If an event in progress is cancelled and not rescheduled, there is no entitlement to a refund of the admission price. This does not apply if the DFM is at fault for the cancellation.
    If an event is cancelled, the purchaser will be refunded the ticket price upon return of the original tickets or upon simultaneous cancellation of the e-tickets. Service and postage charges will not be refunded.

  • 8. Prices, discounts and terms of payment/payment methods

    Ticket prices and the terms and conditions regarding concessions are set out in the DFM’s current price lists at www.fussballmuseum.de and in the price information displayed on site.

    The prices quoted for online tickets are final prices inclusive of VAT. There are no service or delivery charges for the delivery of e-tickets by email.

    When ordering concessionary tickets, holders of such tickets are obliged to provide proof of eligibility for the concession upon request to staff during the electronic ticket check at the turnstiles. If eligibility cannot be proven, the holder will be required to pay the difference to the standard on-the-day ticket price, or entry will be refused. Admission with a discounted ticket is only permitted if the reason for the discount still applies at the time of entry or the event. Holders of an annual pass must present personal photo ID at the box office to gain entry. If the holder cannot provide proof of identity, or if the name on the pass differs from that on the identity document, entry will be refused.

  • 9. Transfer of tickets

    Before use, DFM day tickets and voucher tickets are transferable within the same category or concession group for private use. Naturally, the rule that each online ticket can only be used once also applies here. The annual pass is generally non-transferable and is only valid when presented with photo ID. Vouchers for guided tours may be transferred and used within their period of validity.

    To prevent the resale of tickets at inflated prices, in particular to avoid ticket speculation and to uphold the pricing structure developed by the DFM whilst taking social aspects into account, it is in the DFM’s interest to restrict the transfer of tickets.
    Tickets are therefore sold exclusively for private use. In particular, the ticket holder is prohibited from

    a) to offer the ticket for sale at auctions (in particular on the internet);
    b) to sell the ticket commercially without the DFM’s express prior written consent;
    c) as a general rule, when transferring the ticket privately, to sell it at a price higher than that stated on the ticket.

    Whenever the ticket is transferred, the ticket holder must inform the new ticket holder of the validity of these General Terms and Conditions.

    If a ticket is offered, used or transferred by the purchaser in an unauthorised manner, the DFM shall be entitled to block the ticket and any other tickets purchased by the purchaser – including electronically – and to refuse the ticket holder entry to the DFM without compensation or to expel them from the DFM.

    For each culpable breach by the purchaser of the aforementioned provisions (a–c), the DFM may require the purchaser to pay a reasonable contractual penalty of up to 2,500 euros. The number of breaches shall be determined by the number of tickets offered, sold, transferred or used. This does not affect any further claims for damages. Furthermore, the DFM reserves the right to exclude persons who breach these provisions from purchasing tickets in future and/or to take further civil and/or criminal action.

  • 10. Force majeure, industrial action

    In the event of force majeure or industrial action (lockouts and strikes) resulting in a delay in performance on the part of DFM, DFM may withdraw from the contract.

  • 11. Validity

    Day tickets and voucher tickets entitle the holder to a single entry to the DFM exhibition area or to a single use of a booked service. Tickets become invalid once the holder leaves the exhibition areas via the electronic turnstiles or returns to the foyer via the lift. Re-entry is not permitted.

    The day ticket is generally valid for entry to the DFM on the respective day of the visit or at the specified start time for the guided tour. Participants in a guided tour, a children’s birthday party or any other group-related activity offered by the DFM should therefore arrive at the designated group meeting point no later than 15 minutes before the booked start time. In the event of a no-show or late arrival, the entitlement to the event will lapse and the costs will not be refunded.

    The voucher ticket without a fixed date is valid for three (3) years and entitles the holder to a single entry to the DFM during this period.

    The annual pass is valid for one (1) year, i.e. one year minus one day. Example: from 1 January 2019 up to and including 31 December 2019. The purchaser can specify the start date of the validity period by entering it themselves at the time of purchase in the online shop or at the ticket office. Holders of the annual pass may visit the DFM as often as they like within one year.

    Additional offers, such as voucher cards for guided tours, are subject to the validity period of the associated ticket offers. Example: The voucher card for a guided tour included with the annual pass is valid for the same period as the annual pass, which is one year.

  • 12. Data Protection

    DFM and its technical service providers implement technical and organisational security measures to protect your personal data, which we manage, against accidental or deliberate manipulation, loss, destruction or access by unauthorised persons.

    The DFM uses the data only within the framework of statutory provisions, e.g. for the performance of the contract. For the purposes of credit checks, we exchange address and creditworthiness data with credit reference agencies where justified. The customer/purchaser waives the right to specific notification under the Data Protection Act.

    Our data processing and security measures are continuously improved in line with technological developments. When your data is transmitted to us, it is encrypted using Secure Socket Layer (SSL). Our employees and service providers are, of course, bound in writing to data confidentiality in accordance with Section 5 of the Federal Data Protection Act (BDSG).

    You may object at any time to the use of your data for advertising or market research purposes. Information regarding this right to object will be provided each time we contact you.

  • 13. Place of performance, place of jurisdiction

    German law shall apply. The sole place of performance for services and payments is Dortmund. If the customer is a trader within the meaning of the German Commercial Code (HGB), or if they have no general place of jurisdiction in Germany, or if their place of residence or habitual abode is unknown at the time the action is brought, the exclusive place of jurisdiction for all disputes arising from and in connection with the contractual relationship shall be Dortmund. In the case of cross-border contracts, Dortmund is also agreed as the exclusive place of jurisdiction for all disputes arising from the contractual relationship.

  • 14. Right to one’s own image

    Every purchaser/ticket holder irrevocably consents, for all present and future media, to the use, free of charge, of their image and voice in photographs, live broadcasts, broadcasts and/or recordings of images and/or sound produced by DFM or authorised third parties in connection with an event. Section 23(2) of the German Art Copyright Act (KunstUrhG) remains unaffected.

  • 15. Visual and audio recordings

    To protect the holders of image and film rights, photography and filming are generally not permitted. In designated areas, photography and filming for private purposes are permitted.

  • 16. Customer satisfaction survey

    To ensure that the DFM can continue to offer its visitors the best possible service in future and tailor its programmes and the exhibition experience as closely as possible to visitors’ needs, the DFM attaches great importance to its visitors’ opinions. To this end, after their visit, visitors will receive an email from the DFM at the email address provided during booking, in which they can – on a voluntary basis, of course – rate their visit and submit further suggestions. The short evaluation is anonymous; participation in the detailed evaluation is linked, as a token of appreciation for visitors’ efforts, to an annual prize draw featuring a variety of attractive prizes. To take part in the prize draw on a voluntary basis, visitors must register with their email address; the DFM’s terms and conditions of participation apply.

  • 17. Terms and Conditions of the German Football Museum Prize Draw

    1. The DFB Foundation German Football Museum gGmbH (“German Football Museum”) is organising a prize draw on its website as part of its visitor survey from 11 September 2017 (2.00 pm) to 30 April 2018 (11.59 pm) a prize draw on its website as part of a visitor survey.

    2. Any natural person who has reached the age of 18 is eligible to take part. Each participant may enter only once. Participation using false identities or those of third parties is not permitted. Staff members of the German Football Museum are excluded from taking part. Participants who breach the terms and conditions may be excluded from the competition by the German Football Museum.

    3. The prize offered by the German Football Museum is a pair of tickets to the DFB Cup Final on 19 May 2018 in Berlin.

    4. Entry to the competition is via participation in the online visitor survey. To take part, participants must complete all 13 questions in the detailed version of the questionnaire, which they will be able to access once the competition has been announced. Simply rating their overall impression of the visit is not sufficient to enter the competition.

    5. The closing date for entries is Monday 30 April 2018 at 32:59. Any questionnaires completed after this time will not be considered.

    6. By entering the competition, the user agrees that the German Football Museum may notify them by email should they win.

    7. Winners are required to submit their contact details for the prize to be sent by 2 May 2018 at 10.00 at the latest; otherwise, the prize will be forfeited and a replacement winner will be selected.

    8. Prizes will be dispatched by post by the German Football Museum. There is no entitlement to a cash payment or an alternative prize.

    9. The contact details requested will be deleted once the competition has been completed and will not be used for any other purpose.

    10. The organiser reserves the right to cancel or terminate the competition at any time without prior notice. The organiser will make use of this option in particular if, for factual or legal reasons, the proper conduct of the competition cannot be guaranteed. In this case too, there is no entitlement to a cash payment or the award of a substitute prize.

    11. The conduct of the competition is governed by German law.

    12. Legal recourse is excluded.

  • 18. Liability/Disclaimer and Limitation

    Visitors enter the DFM and the DFM forecourt at their own risk.

    The DFM, its legal representatives or vicarious agents shall be liable for damages, regardless of the legal basis, only in cases of wilful misconduct or gross negligence or – limited to foreseeable damage typical for this type of contract – in the event of a breach of material contractual obligations. Claims for damages arising from injury to life, limb or health remain unaffected by this.

    Visitors shall be liable for any soiling, damage to buildings or fixtures and fittings, or other damage caused through their own fault.

  • 20. Final clause

    By purchasing tickets or other DFM products, the customer/purchaser accepts these General Terms and Conditions as binding. Should any individual clauses be or become wholly or partly invalid, impracticable or unenforceable, this shall not affect the validity of the other clauses or the validity of the contract. Amendments must be made in writing. The failure of the DFM to exercise a right shall not constitute a waiver of the right to assert that right in the future. The law of the Federal Republic of Germany shall apply exclusively.
